These Terms and Conditions of Use (hereinafter the "Terms") govern the use of the mobile application voilà (hereinafter the "Application"), published by VOILA CREATORS (hereinafter the "Publisher").
The App offers a service of digital travel guides created by content creators.
Article 2: Definitions
- "Application": refers to the mobile application voilà
- "User": any individual who has created an account on the Application
- "Guide": paid digital content available for purchase on the Application
- "Services": all the features offered by the Application
Article 3: Acceptance of Terms and Conditions
Use of the Application is subject to prior and unconditional acceptance of these Terms and Conditions. By creating an account, the User acknowledges that they have read and accepted all of the Terms and Conditions.
Article 4: Access to Services
4.1 Account creation
Access to the Services requires the creation of a user account. To do so, the User must provide the following information:
- Name
- First name
- Email address
The User agrees to provide accurate information and to keep it up to date.
4.2 Free application
The Application is free to download and use. Only the Guides are subject to a fee.
Article 5: Integrated purchases
5.1 Purchase of Guides
The Guides are available for purchase via the Application. Each purchase is final and provides unlimited access to the relevant Guide.
5.2 Price
The prices of the Guides are indicated in euros, including tax. The Publisher reserves the right to modify prices at any time. Guides that have already been purchased remain accessible at the price paid at the time of purchase.
5.3 Payment
Payments are secure and processed by our payment provider. The Publisher does not have access to Users' banking details.

6.1 Data collected
The Publisher collects and processes the following personal data:
- Name
- First name
- Email address
6.2 Purposes of processing
This data is used for:
- Manage user account
- Link purchases to user account
- View user profile

- On the Publisher's servers
- On Clerk servers (authentication manager)
6.4 User Rights
Article 7: Intellectual Property
7.1 Rights to the Application
The Application and its content are the exclusive property of the Publisher. Any unauthorized reproduction is prohibited.
7.2 Rights to the Guides
The Guides are protected by copyright. Purchasing a Guide confers only a personal and non-transferable right of use.
Article 8: Liability
8.1 Publisher's Liability
The Publisher strives to ensure the best possible access and functioning of the Application but cannot be held liable for:
- Temporary difficulties or impossibility of access
- Service interruptions for maintenance
- Inaccuracies or omissions in the content of the Guides
8.2 User Responsibility
- Do not share your account with third parties.
- Do not reproduce or distribute purchased Guides.
- Use the Application in accordance with its purpose
Article 9: Modification of the Terms and Conditions
The Publisher reserves the right to modify the Terms at any time. Users will be informed of changes by notification in the Application. Continued use of the Application after modification constitutes acceptance of the new Terms.
Article 10: Applicable law and jurisdiction
These Terms and Conditions are subject to French law. Any dispute relating to their interpretation or execution shall fall within the jurisdiction of the French courts.
Article 11: eSIM Services
The Voilà app offers prepaid eSIM data plans via its mobile app, leveraging eSIM technology for flexible and convenient access to mobile data in many destinations. Our eSIM services are provided in partnership with eSIM Access to ensure seamless connectivity for our customers.
11.1 Registration and account management
11.1.1 Registration
Users wishing to use voilà's eSIM services must register via the voilà app. The registration process requires users to provide their first name, last name, and a verifiable email address. Users can enhance their experience by adding a profile photo and indicating their travel preferences, if they wish.
11.1.2 Acceptance of Terms
Registration is subject to acceptance of voilà's Terms and Conditions of Use and Privacy Policy. These documents govern the use of our eSIM services and ensure that customers give their informed consent.
11.2 Purchase, activation, and use
11.2.1 Choice of packages
Several prepaid eSIM data plans are available, with availability varying by country. Users are encouraged to review their options in the app to choose the plan that best suits their connectivity needs.
11.2.2 Hardware requirements
Before purchasing, users must confirm that their device is compatible with eSIM technology and that it is unlocked. This confirmation is essential to ensure a smooth service experience.
11.2.3 Downloading and activating the eSIM
After purchase, the user is responsible for downloading and activating the eSIM. voilà provides detailed instructions in the app and by email to facilitate this step, which requires a stable internet connection.
11.3 Term of Service, Suspension, and Termination
11.3.1 Commencement and duration of service
The service begins once the eSIM has been successfully downloaded and activated and continues until the data allowance has been used up or the plan period has expired.
11.3.2 Suspension or termination
voilà may suspend or terminate the service in the event of a violation of the Terms, abuse, or fraudulent behavior, with or without notice to the user.
11.4 User Responsibilities
11.4.1 Proper use
Users agree to use the eSIM services in full compliance with these Terms and Conditions and all applicable laws and regulations.
11.4.2 Account Security
The protection and confidentiality of account information is the responsibility of the user. We cannot be held responsible for any loss or damage resulting from unauthorized use of the account.
11.5 Pricing and payment
11.5.1 Rates
The prices of eSIM packages are indicated in euros, including tax. The Publisher reserves the right to change prices at any time. eSIM packages that have already been purchased remain available at the price paid at the time of purchase.
11.5.2 Payment
Payments are secure and processed by our payment provider. The Publisher does not have access to Users' banking information.

Article 13 - eSIM Services, Delivery, and Refund Policy
13.1 Nature of the eSIM service
The eSIMs offered on the Voilà app are prepaid digital mobile data services, provided in the form of an eSIM profile that can be downloaded and activated on a compatible device.
No physical product is shipped.
13.2 Delivery and activation of the service
After payment has been validated, the eSIM is made available to the User electronically, via the application and/or by email, with the necessary instructions for downloading and activating it.
The User is responsible for:
• verifying the eSIM compatibility of their device before purchase;
• having a working Internet connection at the time of download and activation.
Delivery of the service is considered complete as soon as the eSIM profile is made available.
13.3 No right of withdrawal
In accordance with Article L221-28 of the Consumer Code and applicable European regulations, the right of withdrawal does not apply to digital services when performance has begun with the User's prior express agreement and their express waiver of their right of withdrawal.
By purchasing an eSIM on the voilà app, the User:
• expressly agrees to the immediate provision of the service;
• acknowledges that they waive their right of withdrawal as soon as the eSIM is made available.
13.4 Refunds, returns, and exchanges
As eSIM services are digital services that can be activated immediately and are non-returnable, no returns, exchanges, or refunds are possible after the eSIM has been made available.
However, in the event of a proven technical problem rendering the eSIM unusable before any activation or data consumption, the User is invited to contact customer support. voilà may, at its sole discretion, offer an appropriate solution (replacement of the eSIM or other corrective measure).
